Football Kenya Federation (FKF) has been presented with yet another legal headache after Sport Dispute Tribunal passed a verdict to invalidate the promotion of Palos Ladies and Bulema FC to the ongoing FKF Women Premier League.
The verdict stems from a successful appeal lodged by Baringo County Starlets, who sought to contest the decision made by Football Kenyan Federation to relegate from the said league for failing to honour their league matches.
Baringo Starlets, Patron Mr, Samson Cherop argued that their relegation to lower tier without proper laid down rules of Promotion and Relegation Mechanism being followed among others.
The rules state that the promotion and relegation criteria for the league should be made before start of the league and communicated prior.
In its ruling, SDT panel comprising of chairperson, John Ohaga, Mary N. Kimani and Peter Ochieng quashed FKF's lawyers plea to dismiss the case on basis that the Tribunal lacked the jurisdiction to hear the matter before it and went on to hand a verdict on basis of the merits of facts presented.
Among the three commend made by the Tribunal are:
- That the Petitioner(Baringo County Starlets) to be and is hereby reinstated back to the FKF Women Premier League
ii) That the promotion of 2nd Respondent (Palos Ladies) and 3rd Respondent(Bulema) was invalid.
iii) That the 1st Respondent, FKF bear the cost to the Petitioner.
The verdicts dds to many of its recent legal battles and it remains to be seen how the ruling impacts the WOMEN League even as the federation retains the right to appeal.
